Losses

To the fullest extent permitted by law, we will not be liable for any direct or indirect or consequential losses (including loss of profit, revenue, anticipated savings, data, goodwill or wasted expenditure) other than when your subscription cannot be fulfilled, following conclusion of a binding contract and in which case the Royal College of Psychiatrists shall be liable only for the fees paid for the subscription.

Links are provided for your convenience, and inclusion of any link does not imply endorsement or approval by us of the linked website (other than where this is another Royal College of Psychiatrists website), its operator or its contents, and we are not responsible for the content of any such website.

Changes to service or amendments to conditions

The Royal College of Psychiatrists reserves full editorial control over resources on the eLearning Hub and may make changes to the website during the subscription period. We reserve the right to make changes to our website, policies, and terms and conditions at any time. You shall be subject to the policy's terms and conditions in force at the time that you use the website. If any of these conditions are deemed invalid, void or unenforceable, that condition will be deemed severable and will not affect the validity and enforceability of any other condition.

Events beyond our reasonable control

To the fullest extent permitted by law we will not be held responsible for any delay or failure to comply with our obligations under these conditions if such delay or failure arises from any causes which is beyond our reasonable control including reasons of Force Majeure which shall include any default due to an act of God, war, threatened war, act of terrorism or threatened terrorism, lock out, individual action, fire, flood, drought, tempest or other event beyond our reasonable control. This provision does not affect your statutory rights.

Personal accounts

Your right of access is personal to you, for as long as your subscription is valid or for as long as we choose to allow such access (where free). Personal accounts may not be shared, and you are responsible for preventing unauthorised access to your account. You accept responsibility for all activities that occur under your account or password.

Suitability for CPD

Note that under the Royal College of Psychiatrists' CPD arrangements, final approval of any CPD activity lies with your peer group. We aim to ensure that the material on this site is of a suitable standard for use for CPD activities, but individual needs will vary and your peer group will have the final say as to whether a particular module is relevant to your requirements.

Cancellations

Once access to eLearning Hub resources has been granted, if you wish to cancel any subscription you purchase through RCPsych, cancellation shall be at our discretion and if accepted may be subject to a cancellation charge.

Changes of subscription category

CPD eLearning has a Members' and a non-Members' subscription rate. If you have subscribed at the non-Members' rate but then become eligible for the Members' discounted rate during the subscription term we will be happy to extend your subscription to account for the excess money paid. We will double the number of months remaining on the subscription from the time you became eligible for the discount. Please contact the eLearning team to request this as this will not be done automatically.

We are unfortunately not able to provide refunds if you have purchased an individual subscription and subsequently become part of a group subscription.

Intellectual property rights

The content, layout, design, data, and graphics on our website are protected by UK and other international copyright laws. You agree not to adapt, alter or create any derivative work from any of the material contained in the website or to use the material for any purpose other than your personal, non-commercial use. None of the content of the website may be copied or otherwise incorporated into or saved in any other website, electronic retrieval system, publication, or any other work in any form (whether hard copy, electronic, or other), other than for your personal non-commercial use. For the avoidance of doubt, framing of this site or any part of it is not permitted without our express written permission.

Any requests for permission of our images or other use of our intellectual property not authorised by these terms and conditions should be made to the eLearning team.

Use of the data you provide to us or which is collected by use of our website, is governed by our privacy policy.

Trademarks

The Royal College of Psychiatrists' logo and the name 'The Royal College of Psychiatrists' are the registered trademarks of the Royal College of Psychiatrists and may not be used without permission.

Waiver

If you breach these conditions and we take no action, we are still entitled to use our rights and remedies in the future and where you continue to breach these conditions.

Governing law and jurisdiction

These conditions shall be governed by and construed in accordance with the laws of England and Wales.
